Law, justice and human rights committee

Introduction:

In democracy, citizens' rights and freedoms are guaranteed. In fact, this is the very essence of democracy and in it rests the trust of citizen. Democracy is the governance system of people. However, in democracy governance system is carried out through their representatives instead of direct governance by people themselves. In those countries which have followed parliamentary system, parliament plays such vital and responsible role as enacting laws. For the role of rendering assistance to the working system of parliament and making government accountable and responsible to parliament, parliamentary committees which are also called mini-parliament are constituted. In addition to giving direction and opinion, advice to government, the parliamentary committee also performs the act of censoring and calling attention to other bodies of the state after studying and monitoring their act and activities.

          The law, justice and human rights committee is one of the various thematic committees constituted pursuant to article 97 of the Constitution of Nepal and rule 170 of the House of the Representatives Rules, 2018, to render assistance to the regular work of the federal parliament, to make government accountable and responsible to the federal parliament and also to give necessary direction and opinion, advice after monitoring and evaluating the act and activities of the government. This committee especially carries out the work of giving necessary advice, suggestion and direction to the concerned bodies for respect, protection and promotion of human rights. In addition to this, it plays a constructive role to the government and concerned bodies in establishing welfare state and rule of law by making positive reforms in the field of law and justice.

Jurisdiction of Committee

The jurisdiction of the law, justice and human rights committee constituted pursuant to rule 170 of the House of the Representatives Rules, 2018, is as follows:-

  1. Ministry of Law, Justice and Parliamentary Affairs,
  2. Judicial Council,
  3. Judicial Service Commission,
  4. Office of the Attorney General, and
  5. Human rights .

 

Constitution of committee

Rule 169 of the House of the Representatives Rules, 2018, provides that in order to render assistance to the regular works of the House of the Representatives, thematic committees and special committees may be formed under the House of the Representatives. As per rule 172 of the House of the Representatives Rules, 2018, the Speaker may, with the leave of the House of the Representatives, nominate in each committee under rule 170, not more than 27 members except the ex-officio members , this committee was constituted on 2075.4.17 (Aug 02, 2018  ). At present, this committee comprises of 23 members. Members on the committee are  so  nominated  as to  have proportional representation of  the number of  members of the  political parties represented in the House, women, Dalit,  indigenous/nationalities people, Khas-Arya,Madhesi,Tharu,Muslim, backward regions and  minority communities as well .

Secretariat ofcommittee

Rule 189 of the House of the Representatives Rules, 2018, provides for provision relating to the secretariat of the committee. There is a secretariat for each committee under the federal Secretariat. The Secretary -General may designateany senior officer under him/her to work as the secretary to any committee. The secretary to the House of the Representatives shall be an ex-officio secretary to each committee.
